Board of Supervisors Minutes
February 22, 2021

The Tama County Board of Supervisors met at 9:30 a.m. February 22, 2021.  Present: 1st District Supervisor, Larry Vest; 2nd District Supervisor, Bill Faircloth and 3rd District Supervisor, Dan Anderson.

Motion by Faircloth, seconded by Anderson to approve the minutes of the February 16th regular meeting.   All voted aye.  Motion carried

The Board met with Lyle Brehm, Tama County Engineer, to get a road projects report. He presented  an Iowa Department of Transportation Bridge Replacement Agreement #1-20-HBP-SWAP-041 in Oneida Township for approval.  Motion by Faircloth, seconded byAnderson to approve IDOT Bridge Replacement Agreement #1-20-HBP-SWAP-041 in Oneida Township.  All voted aye.  Motion carried. 
Mr. Brehm also presented the following Right of Way Policy for approval:

The Board of Supervisors of Tama County hereby adopts the following policy for right-of-way, fence, and incidentals dealing with right-of-way negotiations:

RIGHT-OF-WAY

                5.21 times assessed valuation.

BORROW AREAS AND SLOPE EASEMENTS

                2.60 times assessed valuation.

FENCE

                If existing fence is located in the project area and the landowner wishes to have it replaced, Tama County will repair the fence. If the landowner wishes to have it removed, Tama County will remove the fence and pay an additional $2/foot.

CROP LOSS

                Corn                                      $800.00/acre
                Beans                                    $600.00/acre
                Oats & Seed                       $150.00/acre
                Hay                                        $300.00/acre
                Pasture                                $100.00/acre
                Damages for fruit and ornamental trees, buildings, wells, etc. are to be negotiated.
Motion by Anderson, seconded by Faircloth to approve the Right of Way Policy as present by the County Engineer.  All voted aye.  Motion carried.

Motion by Faircloth, seconded by Anderson to sign the yearly Certified Local Government Report as presented by Joanne Husak of Tama County Economic Development.  This is in regard to historical preservation in Tama County.  All voted aye.  Motion carried.

Craig Wise, County Conservation, was present to ask the Board to approve a deposit of $2,873.02
to the LAD (Land Acquisition Account) from Homeland Security for 2019 flood damage.                                                                                Motion by Anderson, seconded by Faircloth to approve a deposit of $2,873.02 to the Land Acquisition Account (LAD) as requested.  All voted aye.  Motion carried.
Mindy Benson, EMA Director, requested the Board to make some changes/updates to Ordinance No. V.1 An Ordinance Relating to Hazardous Substances and Waste Requiring Persons Responsible for the Storing, Handling and Transportation of Such Substances to Clean Up Spills at Their Own Cost, and Providing Remedies for Tama County to Clean Up Such Spills if the Persons Responsible Fail to do so and Providing Penalties for the Violation Thereof.  Most of these are due to updates to the Iowa Code and to reflect that Tama County no longer has an Assistant Emergency Manager.  This would update the language in the ordinance to reflect that.  Copies of the ordinance with the proposed changes are available at the Tama County Auditor’s Office.  Motion by Anderson, seconded by Faircloth to set public hearings/readings of these changes for March 8, 2021 at 10:00 am.  All voted aye.  Motion carried.

Motion by Faircloth, seconded by Anderson to approve a Decommission Agreement Plan for Salt Creek Wind.  This was brought to the Board by Todd Apfel, Zoning Director.  It is required to be signed for this project and matches the Tama County Ordinance V1.5 Wind Energy Conversion Ordinance.   All voted aye.  Motion carried.

Motion by Anderson, seconded by Faircloth to approve the claims for payment as presented.  All voted aye.  Motion carried.
