Board of Supervisors Minutes
November 23, 2020

The Tama County Board of Supervisors met at 9:30 a.m. November 23, 2020.  Present:  1st District Supervisor, Larry Vest; 2nd District Supervisor, Kendall Jordan and 3rd District Supervisor, Dan Anderson.

Motion by Jordan, seconded by Vest to approve the minutes of the November 16th regular meeting.   All voted aye.  Motion carried

The Board met with Lyle Brehm, Tama County Engineer, to get a road projects report by phone.

Tama County is currently a member of the Tama County Solid Waste Disposal Commission, which is established by a 28E Agreement in accordance with Iowa Code.  The Commission has decided to update the original 28E Agreement, finalized in 1979, to reflect the modern standards and responsibilities of a solid waste commission in Iowa.  Tama County is in agreement with this.

2020 TAMA COUNTY SOLID WASTE DISPOSAL COMMISSION
ARTICLES OF AGREEMENT RESOLUTION
WHEREAS, the County of Tama, in Iowa, is a member of the Tama County Solid Waste Disposal Commission, as organized under Iowa Code Chapter 28E (“Commission”); and
WHEREAS, the Tama County Solid Waste Disposal Commission was created to continuously study and implement methods and means to efficiently, economically, and lawfully manage solid waste generated by members of the Agreement for Solid Waste Project for Tama County, IA filed in Tama County on January 23, 1973 and the State of Iowa Secretary of State on October 16, 1979; and
WHEREAS, the Agreement for Solid Waste Project for Tama County, IA filed in Tama County on January 23, 1973 and the State of Iowa Secretary of State on October 16, 1979 needed updating to reflect the changes in waste management at the local, state, and federal levels; and
WHEREAS, the proposed 2020 Tama County Solid Waste Disposal Commission Articles of Agreement has been prepared which document includes a new, modernized agreement dated October 8, 2020; and
WHEREAS, the requisite vote by the representatives of the Commission has taken place to rescind the previous agreement filed in Tama County on January 23, 1973 and the State of Iowa Secretary of State on October 16, 1979 and adopt the proposed 2020 Tama County Solid Waste Disposal Commission Articles of Agreement dated October 8, 2020; and
WHEREAS, amendments to the 28E Agreement for the Commission require an approval of a majority of the Commission members by resolution;
NOW, THEREFORE, BE IT RESOLVED, pursuant to the provisions of Chapter 28E, Code of Iowa, the Tama County Board of Supervisors hereby approves that the Agreement for Solid Waste Project for Tama County, IA filed in Tama County on January 23, 1973 and the State of Iowa Secretary of State on October 16, 1979 be omitted in its entirety to be amended in its entirety with the 2020 Tama County Solid Waste Disposal Commission Articles of Agreement dated October 8, 2020.
Passed and approved November 23, 2020.

On July 20, 2020 the Supervisors held a public hearing to consider the sale of property at 2455 Highway 63, Toledo, known as the Marie Hladik Roadside Park and it was approved to sell the property.  Therefore they would now like to proceed with finishing that transaction.  Motion by Vest, seconded by Jordan to approve the following resolution to sell the roadside park:

RESOLUTION TO SELL ROADSIDE PARK
                WHERAS, a public hearing was held at 10:00 a.m. on July 20, 2020, in the office of the Tama County Board of Supervisors to consider the sale of the real property at 2455 Highway 63, Toledo, known as the Marie Hladik Roadside Park, and situated within Section 15 of Howard Township; and
                WHEREAS, a notice of this public hearing and of intent to dispose of an interest in real estate was published in the North Tama Telegraph on July 10, 2020; and
                WHEREAS, after receiving and considering any comments and/or objections, either in writing or by anyone present, the Chair declared the time for receiving oral and written comments or objections to be closed; and
WHEREAS, the highest sealed bid, which was in the amount of $5,000, was received from Martin Hoskey.
                THEREFORE, BE IT RESOLVED THAT:

  1. Tama County will sell the Marie Hladik Roadside Park to Martin Hoskey for the sum of $5,000.
  2. The Chair of the Board of Supervisors and the Auditor are authorized and directed to execute a Warranty Deed and any other documents necessary to effectuate the transfer. 
  3. The Auditor is directed to file with the Tama County Recorder a certified copy of all resolutions and related attachments that are necessary to establish and perfect the deed.

There are some Compensation Board members that need to be re-appointed to represent the Department Heads that have appointed them.  Motion by Vest, seconded by Jordan to re-appoint the following people to the Compensation Board:  Susan Jones for the County Attorney and Dave Forbes for the County Sheriff.  These terms would run through 6-30-2024.  All voted aye.  Motion carried.

Motion by Jordan, seconded by Vest to approve the claims for payment as presented.  All voted aye.  Motion carried.

Chairman Anderson adjourned the meeting at 9:45 a.m.
