Board of Supervisors Minutes
November 4, 2019

The Tama County Board of Supervisors met at 9:30 a.m. November 4, 2019.  Present:  1st District Supervisor, Larry Vest; 2nd District Supervisor, Kendall Jordan and 3rd District Supervisor, Dan Anderson.

Motion by Anderson, seconded by Vest to approve the minutes of the October 28th regular meeting.   All voted aye.  Motion carried. 

The Board met with Lyle Brehm, Tama County Engineer, to get a road projects report.  He asked the Board to approve the following resolution to vacate a portion of Q Avenue.  Motion by Vest, seconded by Anderson to approve the following resolution to vacate a portion of Q Avenue:
RESOLUTION NO. 11-4-2019A
WHERES, interest has been expressed to vacate the following portion of road right-of-way:
A portion of unimproved Q Avenue lying East and North of the intersection of Q Avenue and Highway #63, originally established on September 13, 1858 (See Road Calendar Book A, page 91) and all lying East of the Easterly Right-of-Way line of Highway #63 and Northerly of the developed portion of Q Avenue in NW ¼ NW ¼, of Section 14, T86N, R14W and NE ¼ NE ¼, of Section 15, T86N, R14W of Tama County, Iowa, and
WHEREAS, Iowa Code 306.11 states a hearing is not required if the proposed vacation is part of a road right-of-way held by easement and will not change the existing traveled portion of the road or deny access to the road by adjoining landowners, and
WHEREAS, this segment of road right-of-way meets these conditions, and
WHEREAS, no objections have been received, either in writing or by persons present, and
WHEREAS, this request is only to vacate the established easement for road purposes only and this portion of Q Avenue will be still be subject to restrictions, covenants, ordinances and limited access provisions of record and not of record
WHEREAS, no claims for damages were received,
THEREFORE BE IT RESOLVED that a portion of unimproved Q Avenue lying East and North of the intersection of Q Avenue and Highway #63, originally established on September 13, 1858 (See Road Calendar Book A, page 91) and all lying East of the Easterly Right-of-Way line of Highway #63 and Northerly of the developed portion of Q Avenue in NW ¼ NW ¼, of Section 14, T86N, R14W and NE ¼ NE ¼, of Section 15, T86N, R14W of Tama County, Iowa,
be ordered vacated and closed.  Approved on this 4th day of November, 2019.
Roll Call Vote: Vest, aye. Jordan, aye.  Anderson, aye.  Resolution passed and adopted this 4th day of November 2019.  Kendall Jordan, Chairman, Board of Supervisors.  Laura Kopsa County Auditor.

Motion by Anderson, seconded by Vest to change next week’s meeting to Tuesday November 12th due to the Veterans Day holiday.  All voted aye.  Motion carried.

The Board met with Bernie Lowe and two colleagues, from Bernie Lowe & Associates, to get an update on the health insurance plan.

 

The Board met with Heicey Alvarado regarding a possible abatement of taxes on a property at 702 Church Street in Toledo.  She would like to take over ownership of the property and demolish and rebuild a home there.  She has already approached the City of Toledo and received a waiver of the special assessment maintenance fees in the amount of $1,205.00.  Leaving a balance of $6,548.00 due.  Ms. Alvarado and the supervisors came to an agreement for the amount of $4000.00 to take care of the taxes, interest and penalties.  Motion by Anderson, seconded by Vest to approve abating the taxes, interest and penalties on Parcel 14-22-253-011 at 702 Church Street in Toledo in the amount of $4,000.00.  Title to the property will be turned over after the $4,000.00 payment is made. 
All voted aye.  Motion carried. 

Motion by Anderson, seconded by Vest to approve the claims for payment as presented.  All voted aye.  Motion carried.

Motion by Anderson, seconded by Vest to approach the law office of Moore, McKibben, Goodman & Lorenz to see if they would be willing to handle the land transfers for the radio communication towers.   All voted aye.  Motion carried.

Motion by Vest, seconded by Anderson to set Tuesday November 12th at 8:00 am as the canvas for the 2019 City/School elections held on November 5th.  All voted aye.  Motion carried.
