January 3, 2017
Organizational Meeting

The Tama County Board of Supervisors met at 9:30 a.m., January 3, 2017, for the annual reorganization meeting.  Present: 1st District Supervisor, Larry Vest; 2nd District Supervisor, Kendall Jordan and 3rd District Supervisor, Dan Anderson.

Motion by Anderson, seconded by Vest to approve the minutes of the December 27th regular meeting.   All voted aye.  Motion carried. 

Chairman Kendall Jordan asked for nominations for Chairman and Vice-Chairman for the Board of Supervisors in the year 2017.  Vest nominated Dan Anderson for Chairman and Anderson nominated Larry Vest for Vice-Chairman, these nominations were seconded by Jordan.  No other nominations were received.  All voted aye.  Motion carried.

Motion by Vest, seconded by Jordan to authorize the County Auditor to pay postage, express freight, wages and salaries prior to being audited by the Board of Supervisors.  All Voted Aye.  Motion Carried.

Motion by Jordan, seconded by Vest that the County Auditor be authorized to pay all claims as signed by a majority of the Board of Supervisors in 2017.  All voted Aye.  Motion carried.

Motion by Vest, seconded by Jordan that the following newspapers be designated official newspapers for Tama County for the year 2017: Tama News Herald, Tama; Traer Star Clipper, Traer.  All Voted Aye.  Motion Carried.

Motion by Jordan, seconded by Vest that the following resolution concerning the Secondary Road Department be adopted:
RESOLUTION # 1-3-2017A
TEMPORARY ROAD CLOSURE RESOLUTION.
WHEREAS, Section 306.41 of the Code of Iowa, provided that "The Agency having jurisdiction and control over any highway in the state, or the chief engineer of said agency when delegated by such agency, may temporarily close sections of a highway by formal resolution entered upon the minutes of such agency when reasonably necessary because of construction, reconstruction, maintenance or natural disaster and shall cause to be erected ROAD CLOSED signs and partial or total barricades in the roadway at each end of the closed highway section and on the closed highway where that highway is intersected by other highways if such intersection remains open.  Any numbered road closed for over forty‑eight hours shall have a designated detour route.  The agency having jurisdiction over a section of highway closed in accordance with the provisions of this section, or the persons or contractors employed to carry out the construction, reconstruction, or maintenance of the closed section of highway, shall not be liable for any damages to any vehicle that enters the closed section of highway or the contents of such vehicle or for any injuries to any person that enters the closed section of highway, unless the damages are caused by gross negligence of the agency or contractor.
NOW, THEREFORE, BE IT RESOLVED by the Tama County Board of Supervisors that the County Engineer be authorized to close Tama County Secondary Roads as necessary with the actual dates of closure to be determined by the County Engineer as follows:
                1. For Construction: Any project as described in the approved "Tama County Secondary Road Construction Program" for the year 2017 and any approved supplements thereto.
                2. For Emergency Closure of any road for maintenance purposes: Any route deemed necessary by the County Engineer.

Motion by Vest, seconded by Jordan, to approve the following resolution for construction evaluation relating to the construction of a confinement feeding operation structure:
RESOLUTION #1-3-2017C
CONSTRUCTION EVALUATION RESOLUTION

WHEREAS, Iowa Code section 459.304(3) sets out the procedure if a board of supervisors wishes to adopt a “construction evaluation resolution” relating to the construction of a confinement feeding operation structure; and

WHEREAS, only counties that have adopted a construction evaluation resolution can submit to the Department of Natural Resources (DNR) an adopted recommendation to approve or disapprove a construction permit application regarding a proposed confinement feeding operation structure; and
WHEREAS, only counties that have adopted a construction evaluation resolution and submitted an adopted recommendation may contest the DNR’s decision regarding a specific application; and 

WHEREAS,  by adopting a construction evaluation resolution the board of supervisors agrees to evaluate every construction permit application for a proposed confinement feeding operation structure received by the board of supervisors between February 1, 2017 and January 31, 2018 and submit an adopted recommendation regarding that application to the DNR; and

WHEREAS,  the board of supervisors must conduct an evaluation of every construction permit application using the master matrix created in Iowa Code section 459.305, but the board’s recommendation to the DNR may be based on the final score on the master matrix or may be based on reasons other than the final score on the master matrix;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF TAMA COUNTY that the Board of Supervisors hereby adopts this construction evaluation resolution pursuant to Iowa Code section 459.304(3).

Motion by Vest, seconded by Jordan to accept the County Department Heads appointments of staff in their offices.  All voted Aye.  Motion carried.

The Board met with Lyle Brehm, Tama County Engineer, to get a road projects report.  He presented a contract for the resurfacing of Highway E49 from the Marshall County line to 2 miles east of Montour to the Raven Creek Bridge, close to F Avenue.  The low bidder was from Manatt’s for $2,544,848.93, which is approximately $438,000 lower than the estimate.  Motion by Jordan,                     seconded by Vest to approve the contract for the resurfacing of a portion Highway E49 and authorize the Chair to sign when the contract comes back from the contractor.   All voted aye.  Motion carried.  

Dennis Kucera, Sheriff, presented a 28E Agreement with Cedar Rapids for training purposes for his department for the canine officer.  Motion by Vest, seconded by Jordan to approve the 28E Agreement with Cedar Rapids for the Sharing of Cedar Rapids Properties for Training Purposes.  All voted aye.  Motion carried.

Motion by Jordan, seconded by Vest to approve the claims for payment as presented.  All voted aye.  Motion carried.
