Board of Supervisors Minutes
December 11, 2017

The Tama County Board of Supervisors met at 9:30 a.m. December 11, 2017.  Present:  1st District Supervisor, Larry Vest; 2nd District Supervisor, Kendall Jordan and 3rd District Supervisor, Dan Anderson.

Motion by Vest, seconded by Jordan to approve the minutes of the December 4th regular meeting.   All voted aye.  Motion carried. 

The Board met with Lyle Brehm, Tama County Engineer, to get a road projects report. 
At 9:30 the Board held a public hearing to vacate roads near Otter Creek Marsh.  At 9:30 Chairman Anderson opened the hearing.  Mr. Brehm shared that the roads he is proposing vacating are all within the Otter Creek Marsh and the State would take over the maintenance/use of these roads.  A representative from the DNR was present and confirmed this.  He stated that the DNR is in agreement with this happening.  There were comments from a nearby landowner as to how close the vacation would be to his property.  He had no problem with the proposal.  The hearing was closed at 9:52 am.  Motion by Vest, seconded by Jordan to approve the following resolution to vacate the roads described in the following resolution:
RESOLUTION NO. 12-11-2017A
WHEREAS, a public hearing of the Tama County Boards of Supervisors was held at 9:30 am on December 11th, 2017, in the office of the Tama County Board of Supervisors to consider the proposal to vacate all or a portion of the following roads:
Commencing at the N ¼ corner of Section 12-T82N-R14W, thence easterly to the NE corner of Section 12-T82N-R14W, originally established September 16, 1869 (See Road Calendar Book B, page 158) and modified January 5, 1872 (See Road Calendar Book B, page 238), also known as 350th Street from S Avenue westerly to the terminus.

Also Commencing at the NE corner of Section 12-T82N-R14W, thence north to the south right-of-way line of Highway E66, originally established at an unknown date (See Road Calendar Book B, page 21), all lying in Section 1-T82N-R14W, and Section 6-T82N-R13W, also known as S Avenue from 350th Street north to Highway E66.

Also Commencing at the NE corner of Section 12-T82N-R14W, thence south to the E ¼ corner of Section 12-T82N-R14W, originally established at an unknown date (See Road Calendar Book B, page 21), all lying in Section 12-T82N-R14W, and Section 7-T82N-R13W, also known as S Avenue from 350th Street south to ½ mile north of 360th Street.

Also commencing at a point 50 Links (33 feet) south of the Union Pacific Railroad where that railway crosses the line between the center and the N ¼ corner of Section 12-T82N-R14W, thence southeasterly parallel to said railway to the north-south section line of said Section 12-T82N-R14W, originally established August 13, 1867 (See Road Calendar Book B, page 60), all lying in Section 12, T82N, R14W, also known as 355th Street from S Avenue westerly to the terminus, and
WHEREAS, the intention of the proposed road vacation is to vacate the above-referenced roads along with any modifications, and
WHEREAS, no objections have been received, either in writing or by persons present, and
WHEREAS, no claims for damages were received,
THEREFORE BE IT RESOLVED the following segments of road are ordered vacated and closed.
Commencing at the N ¼ corner of Section 12-T82N-R14W, thence easterly to the NE corner of Section 12-T82N-R14W.

Also Commencing at the NE corner of Section 12-T82N-R14W, thence northerly to the south right-of-way line of Highway E66.

Also Commencing at the NE corner of Section 12-T82N-R14W, thence south to the E ¼ corner of Section 12-T82N-R14W.

Also commencing at a point 50 Links (33 feet) south of the UP Railroad where that railway crosses the line between the center and the N ¼ corner of Section 12-T82N-R14W, thence southeasterly parallel to said railway to the north-south section line of said Section 12-T82N-R14W.
Roll Call Vote:  Vest, aye.  Jordan, aye.  Anderson, aye.   Resolution passed and adopted this 11th day of December 2017.  Dan Anderson, Chairman, Tama County Board of Supervisors.

The engineer asked the Board to approve a contract with Aspro of Waterloo for resurfacing Hwy D65 from Hwy 63 to V37 and on X Avenue from Hwy 8 south to the cemetery in the amount of $1,740,127.92.  Motion by Jordan, seconded by Vest to approve Project #FM-CO86(94)- -55-86, Contract ID 86-CO86-094 and direct the Chair to sign upon the return of the contract from Aspro.  All voted aye.  Motion carried. 

At 10:00 the Board held a public hearing to reclassify two roads to Level B, which requires less maintenance of the roads.  One is west out of Chelsea on 360th Street, S Avenue west to river to R Avenue.  This is known as Dufus Landing.  The Bridge on this road is closed.  The other road is out of Belle Plaine west to X Avenue, there is a bridge over Salt Creek on this road in poor condition.  There were many people present to express their concern over re-classifying these roads.  The Chairman closed the hearing at 10:35.  Motion by Jordan, seconded by Vest to approve Resolution 12-11-2017B to reclassify two roads in Salt Creek Township.

Motion by Vet, seconded by Jordan to approve a letter of support for the Traer Historical Museum project.  All voted aye.  Motion carried.

The City of Tama has presented the Board with a copy of a Resolution for the Voluntary Severing of Territory for the southeast boundary of the City of Tama, along with a map of the new boundary. The city has approved this and is providing a copy of the proceedings and the resolution to the County for their acknowledgement.  The change will become effective upon the Secretary of State’s acknowledgement of these documents also.  Motion by Jordan, seconded by Vest to accept/acknowledge the receipt of these documents.  All voted aye.  Motion carried.

Motion by Jordan, seconded by Vest to approve the claims for payment as presented.  All voted aye.  Motion carried.

Chairman Anderson adjourned the meeting at 10:45 a.m.
