Board of Supervisors Minutes
April 25, 2016

The Tama County Board of Supervisors met at 9:30 a.m. April 25, 2016.  Present:  2nd District Supervisor, Kendall Jordan and 3rd District Supervisor, Dan Anderson.  1st District Supervisor, Larry Vest was absent.

Motion by Anderson, seconded by Jordan to approve the minutes of the April 18th regular meeting.   All voted aye.  Motion carried. 

The Board met with Lyle Brehm, Tama County Engineer, to get a road projects report.  Bids were received for a bridge replacement in Section 4  Toledo Township, 280th Street west of II Avenue.  The bids were both over $250,000 over the estimated amount.  The Engineer asked the Board to reject the bids and open up the bidding again in June with a later start date.  Motion by Anderson, seconded by Jordan to reject the bids for the project in Section 4 of Toledo Township.  All voted aye.  Motion carried. 
The Engineer also presented a resolution for a road closure in Section 1 of Columbia Township that was approved at a supervisors meeting on November 27, 1979 but never recorded.  Motion by Anderson, seconded by Jordan to approve the following resolution:
RESOLUTION NO. 4-25-2016A
WHEREAS, a public hearing was held on November 27, 1979, in the office of the Tama County Board of Supervisors to consider the proposal to vacate the following segment of road:
Commencing at the Northeast Corner of Section 01-T82N-R15W of the 5th PM and running thence West along the section line to the Northwest Corner of the Northeast Quarter (NE 1/4) of Section 01-T82N-R15W; and
Commencing at the Northeast Corner of Section 01-T82N-R15W of the 5th PM and running thence West to a point 6 chains and 83 links West along the section line, thence South 27º 30’ West 3.54 chains, thence South 71º 30’ West 2.71 chains, thence North 87º 45’ West 3.35 chains, thence North 67º 35’ West 4.24 chains, thence North 42º 05’ West 3.045 chains to a point 29 links West of the Northwest Corner of the Northeast Quarter of the Northeast Quarter (NE ¼ NE ¼) of Section 01-T82N-R15W of the 5th PM; and
Commencing at a point on the North line of Section 01-T82N-R15W of the 5th PM, 38 rods East of the North Quarter Corner (N ¼) and running thence South 66º 45’ East 5.75 chains, thence deflect to the left 57º 00’ 4.10 chains to the Section line at a point about 2.00 chains West of the Northeast Corner of the Northwest Quarter of the Northeast Quarter (NW ¼ NE ¼) of Section 01-T82N-R15W of the 5th PM,
All originally established with an unspecified width on August 13, 1867 (See Road Calendar Book B, page 60), all lying in Sections 01-T82N-R15W and 36-T83N-R15W of Tama County, Iowa, and
WHEREAS, official minutes of the Tama County Board of Supervisors indicates said Board acted on November 27, 1979 to vacate the aforementioned road segment, and
WHEREAS, the resolution to vacate the road was not recorded at that time, and
WHEREAS, the resolution to vacate the road has been searched for but has not been located, and
WHEREAS, the current Tama County Board of Supervisors seeks to ensure proper documentation of the vacation in line with the intentions of the previous Board, and
WHEREAS, the requirement to hold a public hearing as specified in Iowa Code Section 306.11 has already been fulfilled by the action of the Board in 1979,
THEREFORE BE IT RESOLVED the above-referenced segment of road is ordered vacated and closed.
Roll call vote:  Jordan, Aye.  Anderson, aye. Motion carried.  Resolution passed and adopted this 25th day of April, 2016.  Kendall Jordan, Chairman, Board of Supervisors.  Laura Kopsa, County Auditor. 
 He also presented Right of Way Agreement 2016-C-170 Hwy 30 for the board’s approval.  Motion by Anderson, seconded by Jordan to approve IDOT Right of Way Agreement 2016-C-170 Hwy 30 as presented by the County Engineer.  All voted aye.  Motion carried.

The Board discussed the Middle Cedar Watershed Management Authority. Motion by Anderson,                                  seconded by Jordan to approve the following resolution:

Resolution approving the articles of agreement
creating the Middle cedar watershed management authority
        WHEREAS, In 2010, Iowa lawmakers passed legislation authorizing the creation of Watershed Management Authorities.
        WHEREAS, A Watershed Management Authority (WMA) is a mechanism for cities, counties, Soil and Water Conservation Districts (SWCDs) and stakeholders to cooperatively engage in watershed planning and management.
        WHEREAS, Tama county desires to enter into an Agreement that would establish a Watershed Management Authority within the Middle Cedar Watershed (Hydrologic Unit Code  #07080205) to enable cooperation in watershed planning and improvements pursuant to Iowa Code Chapter 466B.23 and;
        WHEREAS, Chapter 28E of the Code of Iowa provides the authority for public agencies to enter into agreements for their mutual advantage and;
        WHEREAS, this Agreement is made and entered into by the eligible political subdivisions within the Middle Cedar Watershed that adopt these Articles of Agreement, including but not limited to the Cities of Cedar Falls, Waterloo, Cedar Rapids, Evansdale, Hudson, La Porte City, and Vinton; Benton, Black Hawk, Tama, and Linn Counties; and Black Hawk and Tama Soil and Water Conservation Districts;
        NOW BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF TAMA COUNTY, IOWA that the Chairman of the Tama County Supervisors is hereby authorized to sign and execute the Articles of Agreement for the Middle Cedar Watershed Management Authority, a copy of which is attached hereto and incorporated herein by this reference; and
        BE IT FURTHER RESOLVED BY THE BOARD OF SUPERVISORS OF TAMA COUNTY, IOWA that said Agreement is hereby approved as to form and content and is found to be in the best interest of the County of Tama, Iowa and the eligible political subdivisions that adopt these Articles of Agreement, including but not limited to the Cities of Cedar Falls, Waterloo, Cedar Rapids, Evansdale, Hudson, La Porte City, and Vinton; Benton, Black Hawk, Tama, and Linn Counties; and Black Hawk and Tama Soil and Water Conservation Districts; and
BE IT FURTHER RESOLVED BY THE BOARD OF SUPERVISORS OF TAMA COUNTY, IOWA, that the Tama County Auditor is hereby authorized to file a copy of this Resolution and Agreement with the Secretary of State, as required by Chapter 28E, Iowa Code.

Lori Johnson, Public Health Office, was present to let the Board know about an upcoming Parenting Community Leader Workshop being put on by SKIP.  It will be May 17th at the Reinig Center in Toledo and she encourages community leaders to attend. 

Motion by Anderson, seconded by Jordan to approve the Recorder’s Quarterly Report.  All voted aye.  Motion carried.

Motion by Anderson, seconded by Jordan to approve the Sheriff’s Quarterly Report.  All voted aye.  Motion carried.

Motion by Anderson, seconded by Jordan to approve the Auditor’s Quarterly Report.  All voted aye.  Motion carried.

Motion by Anderson, seconded by Jordan to set a public hearing for an amendment to the 2016 County Budget for Monday May 16th at 10:00 am in the supervisors meeting room.  All voted aye.  Motion carried.

Motion by Anderson, seconded by Jordan to approve the claims for payment as presented.  All voted aye.  Motion carried.
